    Help

    I filed for chapter 7 last year and was discharged in December of last year. There was one thing that wasn't added to my filing and I was told that (for a fee) i can have my case reopened. Before i proceed to pay the reopening fee I need to know if i COULD add this debt.

    I was sued a while ago for an automobile accident i was accused of being in. The case was completely bogus, but since i didn't even find out about the trial until MONTHS before it was over, the plaintiff was awarded a judgment in the amount of $6k. As a result, my license was suspened (this is how i found out about the trial, by getting a letter from the Dept of Motor Vehicles saying my license is being suspended). Long story short, i now owe Uninsured Motorist Fund for my state because they paid the plaintif and now they're after me to repay. I spoke to the lawyer who handled it and he basically told me they had to give false statments at the trial in order to keep the cost down and having the plaintiff awarded more money. I was told it would be pointless to fight this and have this case reopened and that I can't file this under chapter 7.

    One thing is right, no lawyer really wants to touch this case (although it would have been a slam dunk case had i KNOWN about the trail prior to the trial) so I'm finding it hard to open the case. My alternative is to file it.

    Can i file this "debt" that i am being told i owe to the State Uninsured Motorist fund?

    I'm ready and willing to file reopen my chapter 7 debt but if i can't file this particular thing it'll be pointless.

      NO i wasn't in any accident and i'm not even sure if the accident really took place. Apparently, someone sued me claiming i hit them with my car and ran. According to the police report they filed the next day, they were hit early one saturday morning, went to the doctors saturday night, saw my car parked in an area away from the alleged incident the next day (on Sunday), got my tag number and went to the police department that night and filed the report.

      I was never officially served
      I was never arrested or questioned about this. I found all this out after i received the letter about my license and i called Motor vehicles. They gave me the information i need to go to the courthouse and getcopies of court documents after the case was settled (after the appeal time ended).

      this whole thing is strange. There were no criminal charges made, just civil.
