    first time filling and so confused!

    Hi to everyone!

    this is my husbands and my first time (hopefully last time ever) filling ch.7

    Basically our story goes like this, we started to fall behind mortgage payments 6 months ago, house is in foreclosure,we are surrendering house in bk, since we cant possible make the payments anymore on it.... Besides the house which we owe more than what it is worth, we have many many medical bills and credit card bills. I am not working and its been a very rough road financially.

    We just signed our papers yesterday. It feels like now things are starting to just get very confusing and scary. I had mentioned to attorney that about 6 months ago we paid my parents back money that was loaned for mortgge paymnet. its was around 3-4,000. He said he would note that on the papers...

    also, he mentioned about the new auditing law and how randomly they pick you. that had me literaly up all night... we are not hiding anything. the reason why i am worried is becuase he said if you get audited you have to prove every deposit and withdrawl for last 6 months to a year. Well, i dont remember what some deposits where from. like a 100.00 or 300. We unfortunately never kept recipts of groccery bills or gas. i was up all nite trying to see if i can find recipts for any money taken out of bank incase that happens. but i cant. Some deposits may have been from tools he sold. attorney knows about that and said courts dont really care about what is sold its what you borrow and pay back. God, i hope this is over soon. By the way, we have moved out of our house and into an aprtment. Reason being we are giving up house and we needed to move out beofre bk hit our credit...

    i am just so confused and i hope everything goes smooth...

    Any tips or advice on how to get through and remain calm would be so appreciated!

    Things WILL get better. It's always seems to be the worst as you go through deciding to file, then actually filing.

    also, he mentioned about the new auditing law and how randomly they pick you. that had me literaly up all night...
    Try to relax. Even if you are one of the unfortunate souls chosen at random to be audited, your bank has receipts of your deposits and copies of your personal checks written. Also your employers will have copies of your paychecks. Many banks, credit unions, etc have online access to these records as well and you can print them out from there.

    Any tips or advice on how to get through and remain calm would be so appreciated!
    Just remember that we are always here to help during the tough times and to celebrate together during the good times. Bankruptcy moves along on its own timeline, so try not to let the details drive you crazy. Keep your eye on the prize - discharge and closing! Hang in there and keep posting as you have questions.     10/05/06 - Hearing to resolve 2 trustee objections
    01/24/07 - Judge dismisses mortgage company objection
    09/27/07 - Confirmed at last!
    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go

      yes, it is very true, it doesnt seem so bad when you are talking about it, opposed to when you are actually sitting in the office signing away. I am just so afraid we forgot to disclose something and that they will lock us up. I am pretty sure i have discolsed anything and everything to my attorney.

      It is very scary, because of small things, like i told him we sold about 1000.00 worth of things we had in storage so we could pay bills. I asked if we need to include it and he said no. that the trustee is looking for things you paid back not sold.... i hope its all true. i dont wanna be serving time for something like that. i even said to him i am scared about making a mistake and be3ing taken away. and he said most likely you would get a fine and they would deny bk.

      i need to relax i feel like breaking down. I admire everyone on here that has had courage and strength to stick it out and succeed

        Hang in there -- I think the dread of the process is worse than its reality.

        Just wait it out and try not to worry. I spent hours and hours compiling everything -- statements, receipts, values, bank statements -- I had anything and EVERYTHING they could have possibly asked for -- and they didnt ask for a thing.

        You will more than likely be fine. Glad you found us!
