    Need advice about 341 meeting!

    Hello to everyone!!!

    In about a month my husband and I will be going to our 341 meeting. I must say that up untill now, I have been pretty relaxed and positive about the process.... Now, I am freaking out. I have read many horror stories about the 341 meeting, it sounds very scary to me... I know it vary state to state and truste to truste,but I just wish I knew what to expect.

    My attorney has told us the general way it goes, he doesnt seem nervous,but then again he does this everyday and its ni biggie. Just wondering if anyone here is in Illinois and have filed and any advice would be helpful.

    Although I do not live in Illinois, I can tell you that 341's are pretty straight forward for the most part. You should not have anything to worry about as long as you and your husband listed all of your debts, expenses, income and other information accurately and to the best of your knowledge. And remember to prepare yourself and bring everything you can think of. It's a long list and your attorney should be able to provide you with a list of paperwork you'll need to bring.

    Don't freak out, it will be easier than you think.

    Chapter 7 filed - 10/12/2005 - Asset
    Discharged - 02/16/2006
    Case Closed - 11/08/2007

      Ditto BassBoy...

      It's just one of those hurdles that need to be conquered before freedom. With that said, it's a very gentle hurdle since it usually only lasts a few minutes and you are not on trial or anything. It's simply a "meeting" where the trustee makes sure you are telling the truth and asks a few questions. Be prepared and go over stuff that the trustee may ask. That's the best you can do and will usually be more than you need.

      Good luck, just be honest and go over any questions with you attorney. You'll be fine!

        To expand a little more and you'll know how the meeting will start......you'll be asked very general questions. The first one is the, "Do you swear to tell the truth, the whole truth, yada, yada, yada." That's an easy one. You breathe a little better for the moment. Then you're asked if you are (your name), your S.S.#, your signature on the petition and is the petition/schedules accurate and similar type questions. Now you're breathing just fine and your ear lobes stop burning because you're not nervous.

        ......POOF.......Trustee says thank you and sends you on your way.

          This is precisely how our 341 went. It literally took all of about 15 minutes from the time we walked into the door to the time we shook the trustee's hand and looked out our attorney with the "that's all??" look.

            Thanks to all who replied!!!

            Well, I hope ours is as easy as it sounds.... There were minor discrepancies,that i already told attorney about such as paying back relatives, which we paid back my parents 3,000 for helping us with mortgage payments, and also, we told our attorney we have been selling stuff since we moved to an aprtment...we sold like 1000.00 in tools that were ours... he claims that they only our concered about what we repay not whatg we sell... i hope he is right... i am beyond honest with our attorney and he didnt put anything we told him about selling down..i dunno i am scared

              I live in Illinois and we have our 341 meeting this Thrus. I will let you know how it goes . We got a letter saying the only thing we need to bring with was DL and SS and Yes I am nervous as heck just thinking about my heart is beating like crazy !! And it's only Monday By Thurs. I will be going nuts . I know someone that went threw it last year and they said it was fast and easy . I keep telling myself it will be fine .

                Stick to the question and don't give more information than you need to. They are looking for anything they can turn into cash.

                  I was told the same by my attorney that ss card and dl or id is all we need. I know what you are talking about,being nervous and all, mine is like a month away and already im freaking out!

                  Also, I was told that 1 in every 250 bk that are filed,gets audited. My attorney said that its horrible, you have to provide recipts and explanations for every withdrawl and deposit in the last 6mnths to a year.... Im sure you have nothing to worry about because usually it hapens way beofore your 341 metting...

                  anyhow, good luck! and if you can please post back about how it went.

                    Ugh..

                    For those of us who save nothing, have little or no receipts past a few months, I wonder what will happen if we get the audit? Like my husband and I who are just bad money managers?
                    We have had two floods in our basement in the last two years. Dumb me had our files there. Most of everything has been trashed, if I bothered saving it at all. I do have the last few months.
                    Since we have no flood insurance we never filed a claim so we have no proof.
                    I swear sometimes there is a dark cloud following those of us in the worst shape.

                      our meeting went well today Trustee was a grouch asked my husband questions and asked me if I asked you the same questions I just asked your husband would you answer them the same way he did I answered YES (Done !) glad this is over !!!!
