    checking accounts and bankruptcy

    My wife and I were just wondering if the NSF checks that we have out can be included in our bankruptcy. Our account got messed up and now we have nsf rolling in, and of course no extra money to put in the account now.

    Also, we were told that the same day that we file, my garnishments will stop...does that mean that if we file on a tuesday, the garnishments won't come out of my check that Friday?

    Any recommendations on a good way to file this without an attorney that is fast and free?

    The overdrawn account can be included in the bankruptcy. If the bank has paid everything this won't be a problem(except for getting a new bank account). Problem is if some of the stuff has bounced the person you wrote the check to can file a complaint with the district attorney and criminal fines are not covered by Bankruptcy. If this is this case settle w/ the outstanding checks before they take criminal action against you(don't worry about the bank balance).

    About the garnishments, go to your payroll department as soon as you can(after you file) and they can probably stop the garnishment.

    I think there are plenty of Pro-Se litigants on this site that can help you but it still won't be free. I beleive there is always a filing fee (around $150.00 in Texas).

          There is no set time frame. It depends on your individual circumstances. You will be able to get credit after BK, the question is whether you can afford the credit. If you can come up with 50% down payment and are willling to pay 20% interest, you can probably buy a car the day after your discharge ;)

          You can generally expect to be in the "sub-prime" lending category for about 1-3 years after you BK.

          As for Bk fast and free all chapter 7's take a minimum of about 3 1/2 months. The filing fee for a chapter 7 is $209. You can probably find a paralegal service to prepare the forms for an additional $150, or you can prepare them youself.

            Like the one that got me suspended back a couple of years can those be included as well
