    Whats the Most Unsecured Debt You Can Discharge Under Chapter 7 New Law?

    I've seen it posted somewhere on here before, but now I can't find it. I am just curious, what is the cap on how much unsecured debt can be discharged under chapter 7 new laws? Seems like it was in the 200k-300k range?

    I don't think there is a technical limit, however I have heard that if your unsecured debt load is 100k or more that the trustees usually take a very close look and it is likely you will be audited as part of the bankruptcy. I could be wrong though.
    May 31st, 2007: Petition Filed by my lawyer
    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.

      06/01/06 - Filed Ch 13
      06/28/06 - 341 Meeting
      07/18/06 - Confirmation Hearing - not confirmed, 3 objections
      10/05/06 - Hearing to resolve 2 trustee objections
      01/24/07 - Judge dismisses mortgage company objection
      09/27/07 - Confirmed at last!
      06/10/11 - Trustee confirms all payments made
      08/10/11 - DISCHARGED !

      10/02/11 - CASE CLOSED
      Countdown: 60 months paid, 0 months to go

        There is no cap, per se, but if you have a lot of unsecured debt and don't have a pretty good explanation for how and why the debt was incurred, you could face a possible abuse of system prosecution. If you have unsecured debt in excess of about $150K, the US trustee is probably going to look at your case more closely.

          Ahh ok. I could have swore there was some cap/limit I saw posted on here somewhere.

          I was watching someone on tv the other nite, about people that filed bk but there was so much debt it couldn't all be discharged. I should have paid closer attention to the details, but hmmmmm.....
