    Stock Options and means test

    I was given Stock option a few years back and recently exercised them. Would this be considered as income for the means test?

    If you mean that you sold your company stock for cash, then yes, the sale proceeds count as income for the Means Test.

      Just spoke with a lawyer about this at said there is no clear consensus. Company stock is considered and asset and it was a sale of an asset. The means is a backward looking measure of one's supposed ability to pay debts going forward. We only have a limited number of assets.

      Also, I am no longer employed by this company.
