    Can I sale my house yet?

    We filed chapter 7 bankruptcy pro se no attorney 4/10/07 had the 341 meeting on 5/21/07 we live in GA we filed a no asset case we have really no equity in our home our discharge will hapen after 7/20/07 can we sale our home because we really want to leave this town we would make 3 to 5 thousand off of the sale. If we sale will they take our home or our proceeds do we have to get permission? The trustee has not filed anything as far as a motion to abandon her interest in our property but we expect she will soon if the trustee filed something saying she found no assets is that the same thing as her abandoning the property?

    ONE MORE QUESTION
    my dad gave me an old car and boat after we filed and after the meeting of the creditors do I have to report that is it included in the bankruptcy since we got it after the fact we did not buy it it was a gift.
    Sometimes life make you deal with ugly and hateful people ,just think of them as sand paper. They may scratch you and rub you the wrong way but eventually you end up smooth and polished and the sand paper becomes old and worn out.

    It would not be a good idea to sell your house until your discharge (and even better if you could wait until your case closed)

    As for the car -- you would be better off to have your dad wait until your case is discharged to actually put the title in your name.

      If you have no equity in your home where is the $3k-$5k coming from? Don't forget the costs of selling usually equal ~3%. Plus it's a buyers market right now and you will probably get, if any offers at all, less than what you expect.

      I'm in a similar situation with our 341 next week. Our lawyer is advising us to hang on to our home at least until discharge. Then possibly letting the house go into foreclosure if it dosen't sell. The BK & Foreclosure will look appear to be one event on our credit report.

        I have some one who will give me what I want from it. As far as the equity situation according to the appraisal I have no equity based on what the appraisal says it is worth vs. whats owed but we are allowed 20,000.00 in equity so even with a profit of a few thousand we are under that. That is the only reason we want to slae now vs end of july because we would possiably loose the opp. to make a few thousand dollars no one else would pay this much for this house.

          You must wait till discharge, technically, your house is still part of the BK estate until discharge.
