    What is an evidentiary hearing?


    We have one for this:

    STIPULATION AND JOINT MOTION FILED BY CREDITOR AND DEBTOR FOR ORDER
    EXTENDING TIME TO FILE DISCHARGEABILITY COMPLAINT.

    An evidentiary hearing is an official meeting held in front of your district bankruptcy judge where your lawyer and your creditor's lawyer file briefs and may also present evidence on both sides so that the judge can make a ruling for one position or the other.

    I'm not a lawyer, but it sounds like one of your creditors may be asking the court for more time to file a complaint stating one of your debts shouldn't be discharged. Your lawyer should be able to explain what's going on - what does he/she say about this hearing?

    06/28/06 - 341 Meeting
    07/18/06 - Confirmation Hearing - not confirmed, 3 objections
    10/05/06 - Hearing to resolve 2 trustee objections
    01/24/07 - Judge dismisses mortgage company objection
    09/27/07 - Confirmed at last!
    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go

      Basically, I signed a reaffirmation agreement for 3,000 (which is a portion of what they said is allegedy non-dischargeable) and they want to extend the time of filing an objection to 10 days past the last date of the recission period.
      In other words they want to make sure I will continue to make monthly payments, (you get it I'm sure).
      Anyway, this week I shall consult my attorney and tell him I wish to pay the remainder of the 3,000 and they will then have to withdraw the stipulation and joint motion and there won't be need for a hearing as well.
