341 meeting

hi all....info on site is great!!! new to this...i had to do it...no other way...
my 341 is fri july 27,2007. can a few of you tell me what to expect...I am first on the dockett at 9 am...basically a no asset low income case...one judgement and threatening lawsuit from an old sears account which was mainly interest...they wouldnt work with me and bullied me...my notice says nopresumption of abuse does not arise and lists the deadlines for exemptions and objections....lawer says trustee assigned to my case is tough but feels good about the case...after 341 meeting, am paying to have the judgement avoided....how long are these meetings and has anyone ever had creditors show up? thanks alll...guzzie

I can't really speak to your judgement or lawsuit, only that on the day you filed for BK all actions to collect debt from you have been stayed, and you have protection from the court. Which chapter are you filing?

Good luck with your 341. From my experience...

Make sure you know how to get to the courthouse. It probably wouldn't hurt to show up early and watch some cases beforehand to get a feel for the questions. (I wish I had..it might not have been so nervewracking)

Answer your trustee in simple yes or no answers. Do not volunteer any information, or try to explain anything.

My 341 only ran about 3 minutes, but I had/still have no assets to speak of.

Be respectful at all times.

Okay the 341 isn't so bad. My case was pretty simple, I think my 341 lasted less than 2 minutes.

Some things to remember: (I'm sure your lawyer will tell you these too)

1. Don't be late (yes at my time there was one guy who was late, you don't want to be that person.....)
2. Wear only simple jewelry (modest watch, wedding band.....nothing else)
3. Don't bring children to the court. (yes another couple disobeyed this rule...it causes distractions and the trustee doesn't like it)
4. Dress casually. (You don't have to be in your Sunday Best, don't go out and buy a suit for it. Just wear what you might wear if going out to eat for dinner)
5. Do not bring electronic devices (ipods, cell phones, pagers etc)
6. Bring Photo ID and SSN card with you to confirm identity.

You will affirm that you are who you say you are.

The Trustee will just ask a few simple questions:

Has there been any changes?
Do you expect any windfalls?
If there are changes you will notify me.
Did you review the paperwork before signing?
Did you sign the paperwork?
Was the paperwork filled out correctly?
Do you expect any assets for the creditors to be available?

thanks....simple chapter 7...no asset case..will jave a share of house if anything left over...would only be 10 k ...lawer says its exempt....we"ll
see if he earned the 800.00 i had to guarantee him...35 yrs experience..
glad mines at 9 am so i can get the **** out of there. nothing is ever cut and dry till you have that discharge and the case is closed!!!will post fri morning after ive settled down...thanks again....guzzie
