    What is going on Serious help needed

    I looked at pacer (because I can't help it LOL) Countrywide home loan has requested an appearence. Okay the catch is we never ever owned a home. Never!!! They are not even on our creditors list or credit report. the notice has our name but chpt 13 on it but we are still listed as chpt 7.

    Should I call my trustee tomorrow about this mistake??? I hope this does not hold up my case while they search around to make sure we don't own a home. Never ever in our life had we owned a home, had a mortgage our name.

    this is such a horrible mistake on someone. I mean doesn't countrywide mortgage know we never had a mortgage with them by using our ssn??? I hope, no one used our name in fraud.... this is going to be interesting.

    You might call the Trustee and speak to him about it. It is possible someone there made an error in uploading the info and it belongs on another case.

    May 31st, 2007: Petition Filed by my lawyer
    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.

      I would even go so far as to call countrywide?
      Sometimes life make you deal with ugly and hateful people ,just think of them as sand paper. They may scratch you and rub you the wrong way but eventually you end up smooth and polished and the sand paper becomes old and worn out.

        Something is wrong because the letter from the lawyer is addressed to my husband and I.
        I hope I am not looking at some type of identity fraud but I don't know anyone could have gotten a mortgage with our credit scores, we just did not qualify not in the past not now. My husband just finally got a stable job within the last 1 1/2.

          Maybe someone with the same name but different ssn or someone used your ssn and a different name maybe a mix up all together maybe some one gave the wrong case number for the bk and the attorney looked up the case number found your name and decided to address it to you with out even checking to see if it was the correct name or not I dont know but I would contact that attorney ASAP

            yes, I will contact the attorney tomorrow morning and complain and demand a letter faxed to me so I can provide proof of the mistake to the trustee. The last thing I need is to have to prove that I do not nor every owned a home. I know it is a mistake because on the letter it states chpt 13 but we are in chpt 7 our filing status shows that. The lawyer is Georgia, never ever lived there, since Countrywide's is located in California I can only assume the home is located in Georgia.

              Wow. (Not a BK story...but as follows) This reminds me of a situation that happened to me about 20 years ago in California. I went to Sears to buy new tires. I had never bought anything from Sears the whole 3 years I lived out there. They gave me the bill and my first, middle & last name came up as if I had an account with them. I told them I did not have an account with them, never did and never bought anything from Sears in California.
              Only difference was the account that came up was listed in the next town over with a different street address that I had never lived at. Of course I did drive down that street and go to the address & knocked but no one was home then. I had no credit card account with Sears and I still do not but it showed in their records that I had a credit card with them.

              I have a very rare middle name & extremely rare last name. It would be one in ten million that someone with my exact name lived in the same state & in the very next town. I never did figure out what that was really all about.

                I owned a home 4 years ago ( built it brand new )
                and I'm single. I hope that they don't do that to me!!! I sold it in 2003!

                  I just don't need any add problems to my case especially something we did not do. I can't make morning get here fast enough so I can call them. My husbands name is so common and here in Arizona my name is very common but the chances of another married couple with our names is weird. All I would be able to do is crack up if they show up at our meeting, I will just ask who they were and what do you want because we don't know you guys or owe you any money. Wouldn't it be funny if they remove the automatic stay LOL Whoever the property belongs to would never know, they would one day come home and their home has been auctioned off.

                      I know alot of attorneys and I can tell you from which one if I know the attorney if it is a big issue because alot of attorneys out here no offense to anyone but alot of them are very scattered brained and I know of one attorney who does alot of countrywide loan closings maybe the same one.

                          Be forewarned,............. That attny represents CountyWide. Not you. And they probably won't talk to you.

                          Been there. Done that. Got the T-Shirt.

                          I called the Foreclosure Trustee Law Firm when our house was in Foreclosure. I just had some general info questions. Nothing detailed in nature. And they did not talk. They told me to Consult with my own attny.

                            That attorney specializes in getting people convicted in mortgage fraud. They also do some bankruptcy appeals and tax litigation. I would definatly call them and you could possiably call countrywide and speak to customer service see if anything comes up under your ssn. They have a toll free number 1-800-641-8729 they might be able to look up somthing or give you a number to call and get this straight. Good luck!

                              Oh yeah morning gets here GA faster (time difference) so you could call even earlier.
