    This is crazy LOL, LOL.. As hard as I tried to straighten out my credit in the past to get a mortgage, I am now being looked into mortgage fraud or just a mortgage in general

          You can prove it wasnt you . You dont even live in this state. They could compare signatures whatever it takes you can prove through past landlords credit inquiries electric comapnies that it was not you so dont worry. I do feel your anxiety. Also keep in mind that it could in some crazy way be just an oversight or clerical error. So take a deep breath (try calling country wide maybe they are open 24/7 ) or with time difference maybe they are still open. If not just take a deep breath set your alarm very early and call that attorneys office asap. They can say they dont want to speak to you because you are in bk but because you represent yourself you are entitled to an proof of their evidence or explaination of what the heck they are talking about and I am sure if they have a case of idenity theft on their hands they will be interested in pursuing that (that attorney represents mortgage fraud ) maybe the person who did it still lives in the house? Good way of finding them huh, LOL . You are also entitled to the property address somthing right? I think it will be okay.
          Sometimes life make you deal with ugly and hateful people ,just think of them as sand paper. They may scratch you and rub you the wrong way but eventually you end up smooth and polished and the sand paper becomes old and worn out.

            It does help that I can prove it wasn't us but I just don't want the added stress or red flags that this may have caused. Thankfully, I caught it well before the 341 meeting and in time to get it straighten out. I am not worried if the attorneys will not talk to me, they have to because I have no attorney for them to talk to and it was a mistake on their end or someones, heck, my preparer could have done it. but I will let you guys know tomorrow. I am just glad I check pacer. I faxed them a letter as well.

              Have you herd anything yet?

                Okay this is what happen...I called the law office (very nice people) I told them to look at the deed and they found out this person has a totally different name, address, etc. This is such a serious mistake on someone's behalf. I demanded that they correct this asap and forward a copy to me so I can also have the proof in my files. They don't know how this happened but hopefully it will be corrected today. Thankfully, they were the nicest people and very easy to deal with even considering at first I wasn't the easiest to deal with. We all had a good laugh.

                While I was sleeping something told me to just ask them to look at the deed and that made a big difference. I just don't know how this mess got mixed up with me. I only have barely two weeks before my meeting, this has to be cleared up.

                      I am glad it looks like you are probably going to get this straightened out. But at that some time, I had to chuckle a little bit, only because a notice of appearance is largely a meaningless filing. All it means is that whoever filed the Notice of Appearance will get direct notice of all filings in your case (i.e. e-notice) and will be listed as a party in your BK, the Notice has no other purpose and by-itself, has no effect on your BK, your credit, etc. Granted, filing a Notice of Appearance can be a first step to a more involved process by the creditor, but I have a sense this would have probably worked itself out on its own.

                        Thank you HHM, you know how we are before the meeting...everything is a "panic" I noticed that they were a party on my case and I panic. I just did not want any red flags coming up, I did not want them to think I was hiding a mortgage somewhere. I am still curious how we got mixed up with the other debtor, the names are completely different, they live like 2 hours away, social security numbers are not even close.

                          Can't help you on that question...did the people who have the "real" foreclosure file BK. If they did, maybe your case numbers are similar.

                          In any event, it is nothing to panic over...patiently try to get the issue resolved, but don't lose any sleep over it. If the attorney representing countrywide were to file anything else in your case, odds are it would have been some objection or complaint, and attached to that complaint would have been the documents supporting the pleading. Unless the staff of the attorney are really lazy, someone would catch that the names and info are different, and even if it got filed, it would only probably require a simple phone call to the attorney to have the pleading withdrawn.

                              Just received a call from Countrywide and they will be suppling me a letter to provide proof that the Loan does not belong to me and I have been completely removed from the system. Yes, I panic for nothing. I am so mad at myself, I am suppose to say calm, I even purchase st. Johns worts to calm my nerves. The lady I spoke to was soo nice. I is unbelieveable how nice these people are. I had a good feeling today would be a good day. My kids started school today so now I have something to keep me busy, I am really involved in their school activities and the school board.

                                The conclusion..... The attorney finally called me back, he told me he was out of town. He will be taking care of removing the notice off my file. what happened is the lady that the notice is intended to moved from Arizona to Georgia. In Georgia she has the same case number as I do but instead of looking up her case in Georgia the looked up the filing number in Arizona which was us. I swear they were the nicest people. You guys just don't know how I stressed over this all for nothing but the St. John worts supplement works. If you need something for stress and into natural herbs try st. johns worts.
