    Good News?
    Our mortgage company was dragging their feet on reaffirmation. Finally, Pacer shows
    Reaffirmation Document. No hearing required.60%
    Our lawyer has left the firm so we are now
    We still have creditors calling and sending bills. The receptionist (from "the firm") keeps saying to send them another copy of the filing notice and Schedule F. I think that the 4 copies we already sent and two phone calls to them letting them know is enough. When I call, I get an electronic voice telling me that the call MAY

    It might be time to collect this evidence. Violating the stay is very serious work, and I"m sure The Firm would like to hear about it...or at least they should be able to.

    Can you call and make an appointment with a lawyer at the firm. Surely someone has to have been assigned your case. Mention that you feel there has been several violations of the stay in your case.

        It's funny how you call it "the firm" I used to sell insurance and it drove me crazy how your insurance premium is based on your credit score. Like poor people had more accidents. It's actually based on the study that people with "financial difficulties" have more accidents..... AHHH! How ridiculous.

        Oh well, I hope you find a cheaper insurance company. I think your case should be reassigned to another attorney in "the firm" and there is a law that states they cannot call you anymore after you tell them not to call. Of course, that's just the law BEFORE you file... you should check this out anyway, it may be helpful.

          Great to hear from you, NES! Long time, no see! So sorry to see all the "bads" though

          Two suggestions for you....

          (1) Find out where your original lawyer went. She may still be in the area and still able to represent you. If she isn't available, then find out who "the firm" assigned your case to in the office. They aren't just letting the receptionist take care of all of your former lawyer's current bk cases. One of the other lawyers now has you on their case list.

          (2) If "the firm" isn't interested in the blatant violations of the bankruptcy stay you are experiencing, then there are lawyers who very definitely are. Research a good consumer protection attorney at http://www.naca.net .

          Most cp lawyers work on retainer and love going after these scummy collectors. When you have recordings detailing their violations as you do, they love that!

          Check out posts here by member CPO - he's working with a consumer protection attorney right now. Each violation can cost the collector quite a bit of cash (about $1000 for each violation)....right from their pockets into yours and your lawyer's! Also check out posts by FeelingHopeless - she is working with her Ch 13 lawyer right now to sue one of her creditors who violated the stay.
