    What Are The Rules for Living Together and BK?

    I am sure somebody posted this information somewhere and if so, please tell me where it is. I love this site. You guys have so much information that I have actually become familiar with terminology by reading what you have and when I spoke with the attorney and he said some of these words, I knew a little about it.

    Could someone please tell me the rules for people, parents, kids, boyfriends, girlfriends, roommates etc and bankruptcy with folks living together. As most of you know, for financial reasons, people live together to make ends meet. When filing BK, what are the rules for declaration of income? I work and I gave my trustee my check stubs for 90 days and my income tax forms for 2005 and 2006. My daughter lives with me along with her twin girls(7) both of whom are autistic. Even though both of us are on the lease, I pay the rent and she pays everything else (beyond utilities) except my personal debt with her government checks that she receives.

    I do ask her to contribute 155.00 dollars for food for the twins and she takes care of herself and her girls with the rest. I am not sure if anybody here has someone who needs 24hrs care because of a disability, but let me just say for the record, its a huge financial responsibility and an emotional one as well.

    It never occured to me that the trustee or anybody else might be interested in what she gets from the government and to be honest, she and I never discuss money so her finances have never been a concern for me unless she is unable to meet an obligation and this usually involves the autistic twins, so I will step in. When the lawyer ask me what my daughter gives me, I told them about the 155.00 dollars and they put that in my paperwork, however since I have never actually asked her for a copy of her government checks or anything else for that matter, will this be an issue?

    I told the lawyer about being a signee on my sisters savings account with a balance of 268.00 and I know that went in the paperwork, but is the trustee interested in my income or everybody,s income because we all stay together? I noticed some of you mentioned that you live with parents, grandparents and kids and I just wondered what information you had to give to the trustee because I am trying to be honest here?
    341 meeting is August-28-07 at 1:30pm and I want to be ready.

    I'd say they treated it as perhaps additional income. Treating it as perhaps her share of the rent.

    I'm not sure that anything more will be brought up about it. Even if it was she's not responsible for your debt unless of course she was a co signer on any of the debt.

      Yeah I dont think that they will need her income info as she is not filing bk she is jus a roomate or tenant of yours technically so I dont think that wil be an issue but if it does come upmat the 341 just answer honestly as to your living arrangment.
      Sometimes life make you deal with ugly and hateful people ,just think of them as sand paper. They may scratch you and rub you the wrong way but eventually you end up smooth and polished and the sand paper becomes old and worn out.

        I have found that honesty while dealing with all this has been the best policy. If they ask me anything at the 341 meeting, I will be honest but lawyer did tell me that there have been a lot of answers from people at the 341 meetings that have been classic. He told me to think long and hard about my responses to things like:
        1. why did you file bankruptcy?
        2. when did you know you were bankrupt?
        3. do you know what re-affirmation means?
        4. did you ever consider chapter 13 and if not..why?
        5. do you own any property

        Now, don,t get me wrong...he also said that questions like this almost never get asked or come up, but just in case, he wanted me to have the answers.
