    On the Income schedule (Schedule I)

    My wife is NOT filing BK..

    I am the only one filing.

    My wife receives $250 per month from her EX husband for child support.

    There is NO court order.

    He sends it in good faith.

    Do I need to add the $250 per month on her side of Schedule I as income?

    Do I even need to enter her info on Schedule "I" if she is NOT filing BK?

    Since I assume the $250 is deposited in your checking account and trustees sometimes do ask for the last months of account transactions, I would add it to your income. If you leave it out and get caught, bad things will happen.

    If your wife is living with you in the home and has income that she provides to support your household, then yes, you do have to add her.

    On B22A Part II Column B is where her income goes. Then on Part IV Line 17 Marital Adjustment, all of her income that is not specifically used to support the household is backed out.

    This is a complicated and hazy part of the new bk law, so solid legal advice from an experienced bk lawyer in your area will be a big help ensuring this part of the Means Test is done correctly.

        ????? - just curious why you started your original question asking about how to fill out Schedule I if you aren't filling out that part of the Means Test? You must be well below the median income for your state if you don't have to fill out the Means Test then.

        ALWAYS tell your lawyer EVERYTHING about your finances! Don't assume that it doesn't matter. Your lawyer can't represent you to the best of their ability if you hold things back.

        Tell your lawyer about the child support and let him/her tell you whether it needs to be added into your wife's income or not - that's what you are paying him/her for.
