    Question after 341 meeting

    Had my 341 meeting thursday 4/28/05. No creditors showed. Trustee asked just a few questions. Now what happens? I know I have to wait the 60 days. Creditors have till June 27 to object but does the case go to like judge after the trustee. I went to Pacer and it said a judges name on the case. Is that normal. I thought the trustee was the final stop or does it go to a judge after the meeting????

    As long as none of the crditors challenge the BK, in 60 days you will be discharged and not too long after that you will get the discharge paper. You will only have to see a judge if it goes beyond that, which it seldom does, especially if nothing came up in the meeting.

      I will be having my 341 meeting in the next few weeks. What were the few questions that the trustee asked you? I appreciate your time.

          341 hearing

          hey all,
          my husband and I had our meeting 3/24, we were there approx 45 min prior to actual time given to show. there must have been 50 people waiting in room when we walked in. we waiting approx 40 mins before we were called to go into another smaller room. had 2 people go before us. then it was our turn. you have to understand, I'm a worrier, I worry about everything, and by this time, I was nauseated, pale, and profusely sweaty, I felt like I was going to pass out. we were asked to show picture ID and SS card (mine is not on my license) after, we were swore in (thank gosh, I though I was going to pass out). the trustee asked several questions (all the questions were provided by our lawyer for us to look at and know answers to) Did we file tax return, were we getting any money back, all facts stated were factual, any new things that need added, any property, had we sold anything within 1 yr. We were not asked anything that our lawyer had not already informed us of. the only delay was, I have a 14 yr old car(paid off and it still runs), and the trustee wanted to know why the date was listed for the title was in Nov ( I had explained this is when I got the duplicate title, unable to find the original). asked how we obtained property worth (auditors deed) and then thanked us for our time and we left. our attorney walked out with us and said to "expect the discharge in 60-90 days. the whole procedure only lasted approx 8-10 mins. we had no creditors show during the meeting, not even Sears (whom I hear is notorious for showing). we had approx 50,000 in unsecured/medical debt. Reaffirmed on house/2 vehicles. I'm not going to say all went well, cause I'm a worrier, but wasn't too bad!!!!! however, I'm proned to murphy's law, what can go wrong, WILL,. Just try to relax, have all your paperwork together and be honest, in the long run, you'll be better.

            Our meeting was pretty much the same. We got there 2 hours early. Didnt want to be late. It was such a small small room. Took place at our Federal Building. We listened to about 15 other cases before ours. Some people just werent prepared and they had lawyers. Trustee asked everyone same questions like is the petition accurate, did you list all your debts and assets. Have you paid any family member any money in the last year. Are you coming into some money in the next 6 months. Then he asked to see bank statements and tax returns. A lot of people didnt have those which I cant understand why their lawyers didnt tell them to bring them. Trustee said he needed to have those documents within a week in order to continue with their petition. Our lawyer was very prepared. He is also a judge and is friends with the trustee. All in all once we got up to the table it was maybe a whole 5 minutes. He didnt ask to see our bank statement though. Did ask for titles to the trucks(we are reaffirming two and mortgage). And deed to the house. No creditors showed up and we are discharging $116,000 in unsecured credit cards and loans. But they have until end of June to object. O he did look at this one guys bank statement and noticed he withdrew $3000 the day before he filed BK and the trustee wanted to know what he did with the money. Guy didnt answer. Trustee wasnt happy about that. He wanted receipts to where that money went plus the guy got a bonus from Kodak after he filed and he has to give that back.

              The Trustee is the Trustee of the US Bankruptcy Court. A Judge always presides over a Court case. The Trustee reports to the Judge. While the Judge has to be certain that your rights are not violated he is not impartial in this instance. He will rarely go against the Trustee. The Trustee is there on behalf of your creditors. This is not a regular Court. In BK you are attempting to wipe out debt that you admit that you legally owe. Impartiality is not required.

              Anything in Federal Court goes before a Judge. You may never see him though. If you are a no asset case the Trustee will wish to discharge you quickly, usually 90 days.

                341 meeting

                I just had my 341 meeting today and it was very quick. Like most people on this forum I arrived early and listened to several cases before mine was called. The trustee asked the same questions of everyone: did you read the bankruptcy information sheet, did you provide your attonery with the information to complete your petition, did you review the petition, is it correct, have you been involved in a lawsuit, and are you expecting any life insurance or otherwindfall within the next 6 months? The trustee did ask a couple of different additional questions to each person depending on what their case involved. I am filing individual, but they asked how much my wife made and what her monthly expenses were that were not listed on my schedule as household expenses. In all our group started at 3:00PM, I was the fifth case heard in that group and I was walking out of the courthouse at 3:25. The trustee did not ask to see any additional paperwork from anyone and only one earlier case had a creditor show up and it was just to prove insurance on a car they were reaffirming. Looking back the most stressful part to me was going to the lawyer originally and having to admit to someone else that I had gotten my self into so much trouble financially. My lawyer said as we were leaving that everything should be fine and that I should be getting my discharge papers in the mail. The lawyer has said from the beginning that she did not see anything that the credit card companies would contest and I used one up until a few weeks before filing.
