We are in the process of filing a chaper 7 and having our home forclosed on. We have an ARM that shot up $800 overnight. I just can't afford to pay that much extra. Our cc bills have amounted to over 40K. I gave up paying them about 6 months ago. I have contacted an attorney who advised me to file a ch 7 and give up the house. I realize the careless mistakes my wife and I have made over the past few years. It is time wipe the slate clean and start over. My wife and I just passed the means test. We originally did not qualify until the increase in our ARM. Maybe that was a blessing in disguise. We are very nervous that the courts will not grant us a chapter 7 because it was so close. I have heard that in such close circumstances that they may push for a chapter 13. We have having a difficult time trying to find a home to rent because of our credit scores.
