    Does a creidtor have to file something with the court to appear with a claim.

    Long story short we listed an individual as a creidtor in case they decided to sue us even though we do not owe them any money they think we do?

    I don't believe they have to. I could be wrong. If you filed with a lawyer you could call and ask them if you are concerned about this person.

    There is a sticky in FAQ about the 341. Although it may not fully answer your question.
    May 31st, 2007: Petition Filed by my lawyer
    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.

      In order for a creditor to get paid in bankruptcy - any creditor - the must file a claim with the Court..... otherwise they get no funds if funds are available.....
