Adding New Creditors to my Petition BK

    Hey guys,
I added some creditors that were left out of my original petition on Friday 8-17-07. It cost me 26.00 and the bankruptcy clerks office said I could add anybody I wanted. I did this and looked on Pacer this morning and they already have the information posted. What I was wondering was this....the lawyer was there and told me that the amounts are going to be discharged wether the creditors get the notice for the 341 meeting early or a week from now after adding them.

I never question lawyers, but for some reason this did not sound correct to me. But I guess he told me that because the notice that is sent to the creditors says that they have a certian time after the meeting to object......is this what he meant?....I was really worried.

After your 341 meeting, your creditors have 60 days to file objections with the court stating that your debt to them shouldn't be discharged. The creditor has to prove that in court, so that's why there are so few objections - the vast majority of debts are legitimate and can be discharged under Ch 7.

That's why after members have their 341 meeting, we welcome them to the "60 day club". After 60 days with no objections from creditors or your trustee, your case is discharged. Typically closing follows shortly after and you're done and debt-free!

So if the creditor did not get the notice in time for the meeting and receives it after meeting is over, once they get notice, they still have 60 days to object...right?

From what I understand, as long as the creditor is notified before 60 days after your 341 meeting, if the creditor feels they did not receive sufficient notification to object AND they wish to file an objection, they can petition the court for additional time. Most courts will consider 50-55 days of 60 as they will have in your case plenty of time to make an objection
