    Is it harder to file bankruptcy in California?

    I have been reading posts on a yahoo site where some people have said that it is harder to file bankruptcy in California than anyother state....is this true?

    My husband, two children and I are moving in with my parents in Ca to try to get caught up on debt and short sell our house before it forecloses, but still we have a VERY high debt ratio since I was laid off. We may still have to file, but it would be after we move to California. Thanks for your input.

    Trustees are harder because so many filers & many abuses with old BK laws.

      When you say Trustees are harder, what do you mean? Just bullying you around while you are trying to file?

        It is no harder to file in CA than any other state. Also, unless you reside in CA for a certain amount of time, you won't use CA exemptions. Also, CA has a weird two track property exemption scheme.

        But, it is no harder to get a discharge in CA than any place else...remember, BK is federal law, it's "essentially" the same everywhere. The only difference arises in the property exemption scheme, which varies from state to state.
