    police came to my home!

    on friday, while i was at work, the county police came to my home. the deputy left his business card in my mailbox with a message written on it - my maiden & married name and to call him as soon as possible because it is very important.
    i wonder why they came to my home??
    i called the number but i got his voicemail... he's from the eviction unit.
    but i live with my grandfather, so i know i'm not getting evicted.
    but it's so weird! and i'm freaked out because i wont know why until he calls me back!
    would the bk court send the county sheriff to my house for any reason?
    the hearing to lift the stay was friday morning. do you think he was coming about the car? or maybe another creditor is trying to serve me papers?

    Best not to speculate on things that it might be. Better to stay calm and wait for the call back and see what it really is.

      There is a 90% chance that his unit serves the papers in a lawsuit. This means that someone has filed a lawsuit against you. To avoid a default judgment you must file an answer before or on the answer date.

        If someone filed a lawsuit against you while you are in bk from a debt owed prior they are in trouble for violating the automatic stay.
        Sometimes life make you deal with ugly and hateful people ,just think of them as sand paper. They may scratch you and rub you the wrong way but eventually you end up smooth and polished and the sand paper becomes old and worn out.

            if the bank lifted the stay to take the car, are they able to file lawsuit for the balance of the loan?
            i filed my intention that i would surrender the car, so the debt should be discharged, right?

              Yes the debt is to be discharged. No they can not sue you for the balance. That would be against the law.

                I called the police officer again this morning and talked to him.
                He came to my house because 1 creditor is still proceeding with the garnishment of my personal property other than income from work. I told him that I filed bk in June, he wrote down my case number and said he was sending the court order back to the creditor's lawyer.

                what makes me so mad is that this creditor was listed in my bk AND i sent a letter to the lawyer that i had filed!
                i'm considering contacting them to warm them again about trying to proceed with the judgment against me....
                this creditor has been a real thorn in my side, trying to garnish everything! my old car, my bank account, and now trying to come to my home to take from me! and the debt is only $1200!
                i have creditors that hold a lot higher debt than that, and they never got lawyers driving me crazy.

                on the other hand, i think that i might not contact them. let the police send the papers back to the lawyer... it'll burn up some time before my discharge next month... hopefully, they won't try to object!

                    Yes I would call them and threatn to sue for the violation of the automatic stay and I just might sue them anyway for the heck of it.

                      CPO would love these guys, course he'd be suing them and getting another 1000 dollars.

                      Should of asked for a copy of that court order before the officer sent it back. So nice when they make their own paper trail.

                        My attorney said that the courts and trustees take violations of the automatic stay very seriously. So you should think about prosecuting this bastard.
