Odds are, if an objection even came, you would only pay back the $4000 (or some portion thereof--creditors will often negotiate to a lower amount to avoid having to file the objection) but that depends on when you incurred the other balance.

In any event, for objectionable charges, they go charge by charge. You can have some charges that are not objectionable and some that are.

As for gambling, this may be a good time for you to seek some help. Everyone hopes to win when they gamble, but if you are "borrowing" money while facing serious financial problems to gamble, that is sign number 1 of a gambling problem. Unless you can get your decision making under control regarding your finances and gambling, a BK will ultimately not solve your problems.

If something is considered abuse, can u still file a 7 or are u forced into a 13?

First, let's clarify the use of terms.

Abuse = relates to the BK as a whole, this is where the US trustee comes in and says, "hey, you earn to much money to file chapter 7, thus, you are abusing the BK system and need to file Chapter 13...etc etc, or hey, you charged $100,000 to your credit cards in the last month before filing...etc, that is fraud"

What you are talking about is NOT abuse. You are simply talking about an "individual" creditor that may have ground to "object" to the discharge of a "particular" debt. That scenario is of no concern to the BK trustee or the US Trustee. Your BK will go through as normal even if a creditor objection is received. The only difference is, if the creditor objection is successful, then you will have to pay back that "particular" debt, notwithstanding your chapter 7 discharge.

You think you would have learned. You've been talking about filing now for the better part of a year, so pulling these cash advances to gamble more is tantamount to fraud. I'd have no sympathy if you had objections all over the place.

IF I were you I would FOLLOW these steps NOW!!!!#1) STOP GAMBLING....#2) CUT up and DESTROY ALL credit cards and their numbers..#3) Try to MAKE ALL minimum payments for around SIX months so you cannot be accused of FRAUD/ABUSE!!#4) ATTEND GA and GET HELP NOW!!! #5) AFTER 6 months is up talk to an attorney, drag this OUT as long as POSSIBLE to PREVENT problems for you!!!!I am in the same situation... I have THOUSANDS of dollars of credit card bills, I am a COMPULSIVE GAMBLER to the MAX however am seeking therapy and help and thats all I can do at this point.. I am making the minimum payments and will do so until the money runs out and will then probably file for bankruptcy.... I made the charges and will to the best of my ability try to pay back what I can until I can no longer do so... the credit card companies charge HIGH interest rates for a reason.. they know that every year a certain percentage of people will fall on hard times, ect and be unable to make payments... I am one of those people at this point in time...

              Diviaruba-
Why are you here, may I ask? You have three posts and two are very negative and judgemental. Most people come here with major problems in their lives and they are stressed out. We try not to judge why people got in the mess they did since all of us made bad decisions with our money. I am assuming that you are here because you are either going bankrupt or you are a troll. If you want to be a part of a supportive community please feel free to let us know how you need help or how you can help others without being punitive.
