    Rent Problem Question

    Greetings:

    I have a problem.

    I filed for Chapter 7 bankruptcy about 4 weeks ago.

    My court hearing and "meeting of the creditors" is about two weeks from now.

    Paying my bankruptcy attorney pretty much wiped me out.

    As a result, I will not be able to pay my rent on time for the month of September. Due to late rent payments in the past, I have been officially warned that no more late rent payments will be accepted. Starting in September, if I do not pay my rent on time, I will be served with an eviction notice. My eviction notice will probably be given to me a few days before my bankruptcy court hearing.

    All I need to pay my rent is $500.

    In order to prevent myself from becoming evicted and being put out on the street, am I allowed to do any of the following?

    ***Borrow the money from one of those payday loan places?
    ***Borrow the money from a friend?

    I will be able to pay off either of these loans by the end of September.

    Here's another option. I have the type of checking account that permits me to write a "bad check" if I accept a $39 overdraft fee. The bank then gives me several days to get my checking account back in the black. I have done this a number of times before to meet emergency expenses.

    Would this be an allowable option?

    The bottom line is that I want to keep my roof over my head for the month of September.

    Any and all advice and suggestions would be deeply appreciated.

    Could you possibly get an advance from work that would enable you to make the payment on time?

    The overdraft option would remain an option I'd think.

    I would not borrow the money from a friend or a payday loan place, you aren't suppose to take out more debt without the trustees permission.

      Thank you very much for your quick reply.

      I do not think I can get an advance from "work", because I am on state disability retirement (Virginia). I don't think the VRS (Virginia Retirement System) gives such advances.

      Based upon what you wrote, I will definitely stay away from the personal loan idea.

      It looks like my only option is the bank overdraft option.

          [Members, please ignore this very bad advice! Taking out any kind of loan, especially a payday loan, is a terrible idea no matter what the situation is. -lrprn, Forum Moderator]

          A payday loan is paid off in 2 weeks. It's not like a loan where you pay monthly for years. Again how would they know you did this?

            I too am experiencing rental issues while in Bankruptcy. If you have an Attorney, contact them and let them know what's going on. They should be able to include your rental property debt or communicate with them about the Bankruptcy issue. If not, you may want to take the evicition notice with you to your Bankruptcy hearing as proof of debt severity. I'm not sure of what that will do, but it could buy you some time, or help discharge your case? These are ALL guesses here, I'm new to all this as well

              Do Not Take Out A Payday Loan...again..i Repeat......do Not Take Out A Payday Loan!!!! Its The Worst Thing You Can Do....i Have 4 Outstanding Payday Loans Out.....and Im In A Worst Situation Then What I Was In Before.......
