    Sell home immediately after Discharge

    I am hearing conflicting answers about selling home immediately after Discharge of a Chapter 7 no asset case.

    State: Michigan Filing: Under federal exemptions ($40K for house)

    CAN I SELL AND TAKE MY $40K? Obviously it is needed to purchase another smaller, cheaper home in another state.

    Should I hold on to it for one year? Financial burden to do so, but worth it if I can keep all of its proceeds. Is it one year from date of filing or date of discharge that the court will look into your affairs?
    We are very desparatly trying to relocate. Have children that must be enrolled in school that starts on August 8th.

    Any knowledgable advice is appreciated. I do not want to ask BK attorney because he is a "assembly line BK attorney". I do not trust him; do not want to incur any more legal fees from a new attorney unless it is worth it...ie., selling the house and taking my exemption. If possible, then I will hire someone experienced to handle such matters.

    Trustee can reopen your case anytime within 1 year of your discharge date. Being discharged does not mean your case is closed completely unless your documents say so. So be careful. Some times there are other things that pop up that keep your case open after discharge. Often the trustee will keep it open for objections from the creditors.
    I was advised not to buy or sell for 1 year.

      Is the one year period from date of filing OR date of discharge?
