    Counsel of Record???

    Who or what is a "counsel of record"?

    I'm required to service a notice of amendment (schedule C) to my creditors, the trustee and to counsel of record.. who or what is that?!!

    Am I supposed to send a copy of the actual schedule to all my creditors? I'm confused. I know to file the schedule with the clerk and the trustee.. but, why would the creditors get it?Thanks in advance..

    Counsel of Record is merely an attorney who has appeared on behalf of a creditor. You would have received notice if an attorney appeared, they must file a "Notice of Appearance and Request for Notice". If you haven't received any thing like that, than just send it to the Trustee and all your creditors.

      A copy of the amended schedule or just a notice of amendment (to the creditors)? I can't seem to find a legal form titled "Notice of Amendment to Schedule C- property claimed as exempt" Is there such a thing?

        What you are looking for is an "Amendment Cover Sheet" (however, I don't know if every district uses these). This may be a difference between districts, but generally, you are not required to serve the amendment, and if have to serve it, its done by the BK court with you paying the $26 amemdment fee. However, its generally a good idea to serve the trustee.

        However, every district has their own local rules, so don't rely on anything I have said here.
