    Collector ?

    I filed one of the collection companies on my BK and it looks as though they sold the account to another firm, I know this because the new company has the same exact charge as the original collector, can they do that? my 341 is tomorrow.

      Correct me if I'm misinformed, but, I was under the impression that as long as the original creditor and last known collection agency was listed.. that it was covered, NO???

        Yes they can do that, but you can always amend your petition to add this new company to your list of creditors.

          Well that doesn't seem fair. I filed because I cannot pay them or anyone else for that matter. Is this legal for them to do and is there is anything I can do about it?

            I think that is totally NOT fair! Our attorney is filing our papers today, and as I look through old mail I see that some of the accounts have been turned over to collection agencies. So that means THEY have to be listed on our petiton as well as the original creditor???? Well what if in the middle of Bk they switch hands AGAIN?? Do we have to ammend our petiton AGAIN ??

              I have my 341 meeting today. Can I still add any other creditors after today?

                Its really not that big a deal, if the debt is otherwise discharagable, and you discharge the debt by putting the original creditor on notice, than any subsequent assignee (i.e. purchaser) of that debt cannot collect it, if they do, you have a strong claim that you should take to a consumer attorney.
