    Question about family member leasing car for you?

    I have filed chapter 7...already had 341 meeting. Keeping house and have now decided to let car go(big mess..long story). I was going to do a 722 replacement but now my mom is wanting to lease a car for me. It would all be in her name and I would drive it. Pretty sure she her insurance can just list me as a primary driver. I've talked to the attorney's office and they said that would be no problem as long as everything is in her name and I've already had my 341 but they have been wrong about a couple of other things so far..so I'd thought I would ask here. Will my BK affect anything with her insurance rate if she adds me a primary driver? Anything else I need to consider before doing this? God love mothers!!

    Just keep it in her name, everything, don't mention it to any trustees, etc. and you should be fine. After the bk, it will be expensive to do it yourself for awhile, so this is your best bet.

      Stay with the same insurance co. that you are insured with now. As far as I know insurers will not check credit reports on already established policyholders. They only "spy" on new, potential policyholdres so they can rip them off with their BS profiling method.

        Ok..thanks. I have a good driving record ..never had an accident. One speeding ticket in the last 20 years which was about 9 months ago. But anything that I get on my record (tickets or accidents) would affect her insurance then...correct?

          Yes if the car is insured in her name, if you wreck or get a ticket while driving said car it will affect her policy.
