Again, anyone from Illinois wanted to ease my fears of filing? I am wanting gto file but I guess I am afraid to do so if my debts will then fall on my husband?

Still all of your debts that have been co-signed by your husband will still be owed by him if you file bankruptcy. That includes mortgages, car loans, credit cards....the works.
It's crucial that you know exactly whose name is on each and every debt before you file.I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

PHEW. None of my debts have ever been co-signed by him. Not a one! The only co-signer I have is on one of my loans to pay for school. Student loans are not dischargable, but Illinois has allowed me a grace period on payback until the Bankrupty is discharged. I am glad because that bothered me a little. You caught me off guard when you said Illinois and then mentioned husband. I am a single mom who filed pro se in Illinois. The only thing I can tell you about someone elses income concerns my daughters income. She and I live in the same household and share some expenses, but mainly I take care of most of this. I got into debt taking care of her and twin girls who's father is not in the picture leaving them with no income. My daughter can not find sitters for twins and their school hours interfer with most jobs and their starting times. She has one who is autistic and receives SSI for them, but nobody in the bankruptcy filing asked me about her income at all. All my tax forms were in my name, all my student loans were in my name, all my bills were in my name and nothing in my daughters name.
