    Bank Statements?

    Gonna be filing Chapter 7 and was wondering how many months worth of bank statements have been requested during your bankruptcy experience?

    Also, does everyone agree that your should be behind on your payments when you actually file with the courts? I had some activity on my cards and am waiting until they are beyond 90 days before I file...have been paying my bills but am leaning towards not paying them and saving my money for my attorney. Any thoughts on the bank statements and cc payments?

    They will want at least 3 months statments prior to filing. We were behind on about half our credit cards before filing. Current on mortgage and vehicles though. We stopped paying all credit cards about a month before we filed which our attorney told us to. If you know you are filing soon I would stop paying because you are just wasting money giving it to the creditors. But still pay all your mortgage, vehicles, etc. bills.

      my husband and I were with InCharge for about 9 months when we filed. We had not problems at our 341 meeting. And at the time of filing we we weren't behind in any of our payments. I agree with tdooders about stoping payment. I had about 5 months of bank statements, I was worried about money in our account. I only work 4 months out of the year and the rest I unemployed. So when we filed, I was working and we had more income. At our 341 meeting, the trustee didn't ask for any paperwork, except for our vechile titles. (which I was very bumbed about, I worked hard to get all the necessary papers! and he didn't even want to see them!!!)

        Info To Trustee

        I had to deliver to my lawyers office and he forwarded to the trustee
        12 months both personal and busniess bank statements
        2 years of my tax returns
        explane where a loan went in detail
        and some corp records that where requested by the trustee

        It was fine in the end but freaked me out for a few months waiting for the next request. Only had one request and the trustee had all his question answned with this info. He filed a "no asset" case right on time.

        I did have Citi Bank dispute on charge for $3500.00+-. It was just past the 6 months. This was setteled for $2400.00 paid over 36 months. see some of my other post for more details on this.

        Good Luck alot of it depends on the trustee and their questions and if they feel you are honest when you reply. Don't hide anything and shoot strait with them.
