    new collection after 341 meeting

    hello again!

    so i have a new dilemma:

    i have a bank account that was overdrawn when i filed for my chapter 7 by about $800 but i opted not to include it in my debtors list because i was going to bring it back to a zero balance and then continue using it following my bankruptcy.. well i didnt get it to zero quick enough and i just got a phone call from a new collection company telling me that it was charged off to them.. (thankfully i also have a second checking account through a credit union, so i dont have to worry about not having an account or starting with a new bank in case they have put the charge off on chexsystems.. )

    my question is, can i/should i make an amendment to my bankruptcy to include the charged off account even though i've already been through my 341? or should i just make payments to the new collection company? there were no new debits/checks to the account following my bankruptcy filing and it was overdrawn before i filed.. also, if i file an amendment does that start your 60 day wait to discharge all over again? do you normally have to go through another 341 for amended debts?

    I would send them a copy of the petition and if that ends it good if not file the ammendment for 26 dollars. From what I understand if you "forget" to add a creditor that is not a secured creditor that would have other wise been discharged it is considered discharged. But honestly you should just ammend it for the 26 and be done with it. Why pay on something that you can have discharged you are supposed to legally list all debts.
    Sometimes life make you deal with ugly and hateful people ,just think of them as sand paper. They may scratch you and rub you the wrong way but eventually you end up smooth and polished and the sand paper becomes old and worn out.

      Similar circumstances

      I added my overdrawn account for the $26, and it was well worth it. I was able to provide Chexsystems with a faxed copy of my discharge and the baddie was removed from their report. FYI just in case you ever needed to get another bank account before the 5 year wait period is up. It was well worth the fee. Be sure to add your bank and the collection agency. You can add as many new creditors to the matrix for the $26 as you want at one time. If you have to add another one at another filing time, then it would be another $26. I don't have answers for your other questions. I think the answer is NO and NO, but I have no proof of that.

        NO you dont start all over again. No you dont have a new 341 for it.
