    It's always something..

    I'm always worried about something. Always. Now, I'm worried about my car. In my thread the other day, I told you guys I had my lawyer convert my case to chapter 7 from a chapter 13. The paperwork was filed last week.

    Now to the point. When I filed chapter 13, the car company was asking for $2000.

    I really want to reaffirm my car. My normal payment is $322/month. Are they going to want the $2000 dollars for me to be able to reaffirm my car? Will the work out some kind of payment plan. Due to my husband's job, he would probably lose his clearance if our car were repossesed.

    Please help!!!!

    When you filed chapter 13, were you $2,000 in arrears, or was that the "unsecured" portion of the note (i.e. negative equity).

      I owe like 13000 on the car, which is worth about 8000 dollars. I am really upside down in the car. They were asking for a payment of around $2000 dollars when I filed. I'm not sure what arrears means though.

        I had missed 3 payments when I filed bankruptcy. I'm not really sure how they came up with 2000, it should have been around 1200 or so..

          If you're $5000 in the whole...Let them take your car ang get a new one.....

            Can't do that because of my dh's job. That's why he didn't file bankruptcy, I filed alone. The car is on his report because he cosigned for it, so I really need to keep it.

              The $2000 figure could have the $1200 you are behind along with late fees and other charges rolled up into it.

                If your Dh cosigned for the car and you only filed. They will go after him for the remaining balance? His credit was trashed with the car not being paid for. Why didn't you include him with your filing?

                  Yea so this is turning into a big mess. I'm thinking I should have just stuck with my chapter 13, but what's done is done. He didn't file because he can't because of his job. We had to get approved for me to file. All of the bills were in only my name besides the car anyway.
                  Why was his credit trashed because of the car?

                  I talked to the car company and they said his cr would read "included in chapter ** bankruptcy" . They also told me that once the car is paid off we can request his credit report to be changed to "paid in full"

                  Now the only problem is getting the car reaffirmed, which we are working on.

                    OK I have another quick question... The car company said that if I paid them the 2000 dollars to get the account current, they would send the reaffirmation agreement to my attorney.. Is that pretty standard practice or is that something I should get in writing?

                    I mean would they come and repossess the car anyway, even after I paid them the $2000? Could they just be telling me to send them the money so they get my money, and then repossess the car anyway?

                    Do you know what I mean?

                      That is common for them to request the past due amt up front before they reafirm. They can not repo if you are still current after you catch up and reaffirm. If you dont mind me asking wht line of work id dh in that you had to be approved before filing? Sorry I am just curious
                      Sometimes life make you deal with ugly and hateful people ,just think of them as sand paper. They may scratch you and rub you the wrong way but eventually you end up smooth and polished and the sand paper becomes old and worn out.

                          You can't be fired because you file bankruptcy. It might could affect security clearance level though not sure in the military. (Never even heard of the military pulling your credit report though they could do that these days)

                          How many days have you had the car?
                          May 31st, 2007: Petition Filed by my lawyer
                          July 2nd, 2007: 341 Meeting Held
                          September 4th, 2007: Discharged and Closed.

                            We've had the car almost two years, and yes my husband does have a security clearance that is affected by what is in his credit report.
