    I had my 341 a few days ago, Texas ch7 no assets. I live in my mother's house (paid for), she is in a nursing home nearby. The trustee instructed me that if she dies within 180 days I am to notify his office. The house would eventually be willed to me and my sister. I would like to keep the house for myself by buying out my sister's portion. To add a monkey wrench to the gears, Medicaid MAY decide they want to come after the house to cover my mother's care that they have been paying for. We don't know what they might do or how long it will take to decide. Could take a year or so. My question is, who has priority over the house after my mother passes away? Can the trustee force a sale of the jointly owned house? That would put me out in the street. If Medicaid takes it, I would still be out in the street. How else would the trustee know if she dies unless I tell him. Thanks

    Check with state/county laws, but they will more than likely put a lien on the house and once she passes they will get the money from the sale. If she is out of the house for 6 months they might do so then as well. Call a local long term care salesman as they usually have the scoop on local and state laws.
