    income taxes & Chapt 7

    Can you include unpaid income taxes in Chapt. 7? We probably won't be filing until April '08. We pay my husband's income taxes every April (he's a subcontractor) and his taxes aren't taken out of his paychecks throught the year. We'll proabably owe a few thousand in April towards his taxes. Can we put this in the BK, or do we have to pay it separately?

    Nope.

    Recent taxes are not Dischargeable. They have to be older than 3-4 years to even be considered Dischargeable.

    I used to know the exact time frame, but have forgotten as Taxes weren't an issue for us. Maybe someone who knows will chime in for you with the exact time frame.

      You will have to pay, your taxes for tax year 2007 (for which you will file a return in Apr. 2008), are too recent to be included in the BK. You will have to pay them one way or the other.
