    HHM- Robivi- Had our 341 today.. oye vay.

    Well.. we went pro se. I'm pretty sure that we were treated the same as those who did have representation. So, that was good. In all honestly, we were treated with respect, dignity and integrity.

    Our trustee is going to object to our exemption of the only vehicke we have. Our 1995 Chevrolet Blazer LS with 124,000 miles.He's taking it because he claims that NADA says it's worth 4200.00. Never inquired about condition or anything... OK. KBB and Black says 885.00. Recent one sold for 950.00 in auto-trader.. hmm.I claimed 1000.00 (FLoridas max) God Bless him if he thinks he'll get that much. I saw him take at least 15 cars today.. most others were "extra cars".

    I brought 3 months bank statements, titles to the house and car, paystubs, house valuations... didn't ask for a single thing. Nada. Would not even look at KBB. Nothing.

    I told him we would call him on Monday ( holiday, we all forgot-will call anyway) to work out the arangements and the decisions. Hmmm.

    So.. q then. if he had other objections- would he have brought them up today? Would he have let me know? Will he be satisfied with the surrender of the car- or should I be worried?

    I mean, it's effed up, but- really a small price to pay and really, we're grateful. Now that we are a 3000.00 "asset" case.. will the creditors be blood thirsty? What do you think?

    ugh.. not as good as I had hoped. Not as bad as I feared, so far.

    If he had other objections, he may not have mentioned them.

    The creditors don't care.

    I am a little surprised that Florida's max on cars is only $1000, but yeah, I checked Blue Book on that car, and its market value is over $1000. But your right, I can't believe the trustee would take it, it is probably more hassle to try and sell it at auction.

    That will probably be it, you will probably have to surrender the vehicle.

      Out of curiosity, what would happen if in fact he ended up not being able to get any more than the $1000 for the vehicle?

      Also, what would happen if you surrendered a vehicle that supposedly was worth more than you owed on it, but at auction it did not fetch even enough to cover what was owed (due to mechanical defects, etc.)?

      Lastly, is it possible to have a vehicle professionally appraised, and THAT value used by the trustee?

        The trustee takes cars free of liens, in come cases the trustee is able to extinguish the secured debt and it gets rolled into your discharged.

        Sometimes, you can offer to buy the car from the trustee...expecially if the trustee takes it free of liens.
