    How Are The Trustee's In Middle District Of Florida

    Just curious as to what I need to expect.

    Filing ch7 with assets, $70k in the hole, not any single item worth over $200.

    My wife is also pregnant and the baby will be due about the time we are knee deep in this mess. I have included the babys expenses as if baby was already born. I mean heck my wife needs a new outfit weekly. I need to build the nursery, getting ready cost money.

    My house needs repairs still from the hurricanes that hit last season. I have been trying to have a garage sale for years, my wife is a pack rat, I hope they would come in and take all the junk, well I feel its just junk most women think its cute

    If anyone has some advice please help, I feel like jumping off a nice tall building!!!!!!!!

    Why are you filing Chapter 7 WITH assets? What assets do you have if nothing is worth over $200? Just curious. You have enough to deal with with a baby on the way so try not to stress over filing. Garage sales are great but it is usually a one time event; every little bit does help though. I had a few sales too.

      There is such a thing as Chapter 7, small asset case. In fact, I read that the number of small asset CH7 cases are sharply on the rise, due to the diligent work of the Trustee's sniffing out ANY assets that are worth persuing.. and that criteria has dropped from them going for 10's of thousands to just a few thousand. Overall, it adds up to some pretty big bucks in the big picture.

      My case, so far, is a perfect example of that.

      What kind of assets do you have, OP, that are outside the exemption levels? Florida is really cracking down.

        Well with $70K in unsecured dept its time I just cant make ends meet.

        Between me and the wife we are allowed $2000 in exemptions. The boat and 2 skis I will be giving up. I owe my cu $18 and they have the loan on my worthless Jeep that I owe $2100 on that will probably be taken due to the other amount I owe to them. When I go thru the house with a very fair value on all items Im about $1700 over my limit. I willing to let them take whats needed if that be the case, I really need a new start on life, BABY AND WIFE ARE THE MOST IMPORTANT!

        My wife will be taking a permanent leave from work when our child is born. With my income we could make it, but not with the dept we are in at the time. Heck, they may even take my tools I make my living with which are worth as much as some homes. Ch13 will not work since we are in the hole at the end of the month by as much as -$450, wont work. I rather try ch7 and just be honest about my situation and see how bad it is, I keep the roof over my head so thats a start.

        I cant put this off much longer because of the new laws going into effect on Oct 17, they already seem to be trying to push ch13 down everyones throat.

          Oh and the best thing in the house is a $500 pool table at best its worth $200 now, they can take it I need the room.

          My 5 year old big screen T.V has been on the blink about ready to die, they can get that out of the way.

          I closed my bank accounts because I think the CU might try to keep my money.

          The rest of my things were made by me, or they are thrift store, garage sale items. They can take it if they want, Ive been trying to clean up anyway. It would cost them more to take my things. Like my wife said its all material!
