    Payment to Chap 7 lawyer

    I have read here that some lawyers only take cash or cert check. Does the trustee ever ask where you got the cash to file?

    Speaking from my own experience, I made two payts to my lawyer, one was in cash (he didn't require that, however, or a certified check) and the second payt was a credit card issued check from my son's own account, signed by my son. No quibble over that either.

    My trustee did not ask where I got the money to file.

    I think, from all I've read, that isn't a very common question. Anymore than is "how did you get yourself into this mess?"

      To my knowledge the Trustee's rarely ask where the money comes from to pay the lawyer. It's sort of an unwritten rule in the BK community.

      Honestly, there is very little the trustee could do about it...the attorney expense is considered reasonable by the court.

        I asked my lawyer the same question. He said don't worry about it because the trustees know that you can't file without paying, and they also know that people stop paying on the credit cards way in advance before they file.
