question about additional info. supplied after 341.

After our 341 meeting we got a letter stateing that the us trustee was wanting to dismiss our case for substantial abuse, because the cars are both in the non filing spouses name yet two car payments were listed on the expenses. So they asked for proof of cars, proof of child support, 3 years tax returns, and 3 mo. paycheck stubs. We provided all of this then my attorneys para legal called to ask questions about my paycheck stubbs. When I called the attorney's office later that day I was told that they verbally provided the info. the trustee was requesting, and the case was being closed. What does this mean?

Why didn't your attorney tell you what it meant? Did they mean the case was closed and you couldn't file a Chapter 7 or the "case" from the trustees objections is closed? Confusing. Regardless, I would call my lawyer asap and ask him/her. Just for the record(no pun intended) why did you list the cars when they belonged to a non-filing person? The problem is when this happens, willful or not, the trustee will be suspicious of any of the paperwork you submitted.

It probably just means that law firm satisfied whatever objection the trustee had and the matter is closed, so your case should proceed to discharge. But you should clarify that with your attorney.

it sounds like all they had to do was amend you petition to show the cars as assets, not a big deal.

ok so I called my attorney back and she said that we satisfied the trustee's request and the law firm should receive a letter from the U.S. bank. court within a week. Well yesterday was a week and no news Deadline for objections is this coming monday. What is going on?

I wouldn't sweat one day late.. I think the courts are getting really backed up. My 341 was on 5/26 and they just yesterday got around to updating the info on Pacer. You should definitely sign up for that https://pacer.psc.uscourts.gov/.. it costs a little money.. like 8 cents a page to view.. but, it's well worth it. Just go there and register to get your password.. it's easy, takes a day or two. Keep your fingers crossed that there are no objections or extensions by Monday.. cuz' if there aren't.. they are SOOL!
