    COULD a CREDITOR garnish WAGES or LEVY bank account after filing BK? Please Read Below.

    (hypothetical situation below)

    Pending CC lawsuit (don't answer summons/complaint)
    Creditor gets judgement NOV 20th
    I file my BK on DEC 1st.
    Wages get garnished starting DEC 3rd (after filing BK Dec 1st)

    Could the above "situation" happen? Is it likely to happen?

    First, a creditor is going to take more time than that between getting a judgement and acting on it, usually with more demands for payment, then going after bank accounts that you have previously paid them with because they have the acct info and it is the simplest for them. They look at it as if they clean out your bank they get paid all in one shot, rather than payments from garnishing wages. Then they seem to go after several banks in your area searching for other accounts. As a last resort they try to garnish wages. They really don't like to do that because you can stop it just by changing jobs.

    So, simple answer..... Could it happen....Nope.
