I have a question regarding the payments to atty. My attorney has me making 6 monthly payments of 350.00 to file ch 7 (I live in PA). If i need to show +-100 on schedule i/j and they look at my bank records and see that i can pay him 350/mo does that shoot my +-100 in the foot? Granted some expenses are accrued (i.e. car insurance) and maybe i'm thinking too much about it, i have so much time until i file in april 08 that i sometimes come up with these stupid questions that i think the trustee might ask, and i really appreciate the answers i receive here from those that have been there before.

You know, I haven't paid anything yet and I also wondered the same thing.
For me it was credit card payments on secured debt I wondered about.
Anything you spend on expenses outside of living expenses will certainly lower your six-month totals for real living expenses.
I only hope that I can claim reasonable expenses when I file and that most of them won't be questioned because I won't be able to prove the expenses because of the same problem you have. Hopefully I can file using slightly inflated expenses because I can't prove them all.Discharged November 2008 100 days after filing no-asset Chapter 7. We intended to let a two-year-old vehicle go back to the bank and reaffirm an inexpensive ten-year-old SUV and our home mortgage. In the end we surrendered ALL of our vehicles and reaffirmed NOTHING. We'll "ride through" our mortgage after the court ruled it an undue hardship.

I am in the same boat too. I am not filing until March and paying the atty as well. I read all these posts and freak out that something's going to happen at the 341 hearing. We are moving to another state next month and we have to wait the 91 days to file and I keep thinking what's going to happen between that time. We've taken cash out so that it can't get garnished from our checking acct and the atty said that's okay but not to do it again because of the time frame, but I keep thinking what if the trustee does question it? We are federal exempt so it may not be an issue, but I can't help but worry to death about everything!

a.fla I'm like you. I wont file until April (as long as not creditors sue before then) and at times I feel pretty good that my case is cut and dry, then into my mind creeps in an idea of what about this, what will the trustee say about that! pa308, I totally hear you. There are times I won't go on this board at all because I think, we're good. Then I think what if we get sued (I have a feeling CITI is going to go after that), then I get completely FREAKED out all over again. My lawyer keeps telling me to calm down and to let him deal with it, but we have about 68k in debt and I just know one or more of them are going to try to make us pay them back. I've never stressed so much in my LIFE!!!
