    Sears

    I bought some items from Sears over the years. None are what I understand
    would be considered a "major item" (looked everywhere for a definitive answer and none. Asked them and got a vague answer, but something like refrigerators, large home heaters, large mowers, washer/dryers etc.) I do have a small 9" TV and an inexpensive DVD/VCR player that are only two years old. I am current on my bill (been paying $100.00 a month for over a year) and also have had a $0.00 min. amount for over a year. I asked about the original price for a 4-year-old small room air conditioner I had lost the receipt for and they informed me that they only kept records for two years, but that they could retrieve that information for me and send it in 15 days. That was a few months back. The question is this: I don't have any major items from them. I don't want to reaffirm or redeem exempt items that they haven't questioned, sued for etc. that I don't have to. If they do show up at the '341' meeting can I redeem what items they do ask for (assuming is only the most current ones) or reaffirm if necessary at that time. If they don't show up or hadn't sent me a letter asking me to reaffirm, redeem or give back certain items all the way from the time I file to the time I get my discharge papers, can they try to repossess anything at that time, and if necessary, at that time, can I reaffirm or redeem? Also how do you find out what the liquidation price, for such items are. Many of what I have that is electronic based is 'discontinued', can't be found, or I have found for a greatly reduced price for a new item.

    I have a friend who filed BK and Sears was one of her creditors. She had a washer and dryer and a kid;s gym(backyard) and a swingset that she had purchased from Sears over the years. I think the washer and dryer were fairly current(within 3-6 months) but I dont remember how long she had the kids stuff. Anyway, Sears showed up at the 341. They told her attorney they wanted her to pay for those specific items because none of the other stuff she bought from them was really worth anything. She did. They even made her payments reasonable. This was several years ago so I dont know for sure how they are now. Maybe someone on the forum had Sears for a creditor.

      I filed chapter 7 on 3 retail accounts, one of which was a $3,500 furnace which was bought 70 days prior to filing from Sears. Not one creditor showed up at my hearing and I was just discharged a week ago.
