    2 Car Recently Traded in

    My wife and I are submitting filing for chp 7 next week and I want to know if this will be a problem.

    I recently (30 days) ago traded in our two vehicles for two newer ones.

    Vehicle one (free and clear) - Took it to carmax and they offered us $350 for it. So traded it in at a dealership for a $3,000 credit on the newer car. Was traded in because it was having engine problems and no AC (must have in Florida)

    Vehcile two - (lien) pmt $415 - Took it to carmax and they offered us $5,500 on it but owed $7,000. So traded it in a dealership for a $10,000 credit on newer car.

    Now we have two vehicles with payments at $490. $75 higher than what we were previusoly paying.

    Will this present a problem with the trustee becasue of the trade in value that the dealership gave us?

    Your bankruptcy estate is set on the day you file, not a month before. Your car trades were reasonable and through a legitimate dealer, not an insider. The increase in your total payment for both cars is only $75.

    Unless I'm missing something obvious, I don't see where a trustee would have a problem with this situation.
