    Rent And Insiders

    I'm just getting myself put together, trying to stay afloat as long as I can- hoping for something positive to happen(like a promotion) that will make it so I don't have to do this.

    I currently make 37K in CA. I pay $587 for my car which is about a year old. It's not fancy(a Ford Escape- expensive because I suck at making deals- still 4.9% int), but it is strong and stable and reliable and I'll need to hold onto that. The warranty on it is ironclad(covers just about everything). I suppose that will be something I'll need to discuss with the lawyer when the time comes.

    Anyway, I'm looking down the barrel of around 40K total in unsecured credit cards as well as back taxes(all forms filed, on payment plans with the IRS- those fall in those more than a certain amount of days bit).

    My question is this: I rent a room from my sister who owns her house with her husband. I pay them $700 for the room plus $200(give or take) for utilities a month. Am I going to run into issues where these payments are considered insider payments?

    I kept thinking that with me being well below the median and having the debt I have, it should be no problem, but then I keep coming up with new things to worry about.

    Thanks for the help, though you'll excuse me if I say I wish I wasn't having to ask for it. I feel rather sick to my stomach doing so.

    There shouldn't be an issue. The bk court expects you to live somewhere and at some monthly cost of either rent or mortgage payment. As long as the $700 is 'normal', they probably won't even look at it - just list it in your expenses for housing.

      Be sure that you have receipts to "backup" rental payments to your sister/husband...... $700.00 a month plus $200.00 for utilities for "room rent" is more than most peoples house payments!!!!

      The proof is in the receipts................

        I live in California where standardized monthly rent is almost 1K for a one bedroom.

        In any case, thank you.

        I've never had my sister write a receipt- I've always just given her a check..maybe I should ask her for a receipt. Feels weird.

          I think that would probably be about average or maybe even below for RENT in CA. Home prices there are even more outrageous.

            Don't really know how you will "swing" the median income/total household income issue since you live with relatives/other people.

                  Am I going to run into issues with the median income? Even though I'm living with a married couple and I'm just essentially renting a room?
