And then getting pushed into a CH 13? I'm so nervous about this. My attorney keeps telling me not to worry and I trust him, but as we are finally at the point of filing... yikes. I'm just nervous.
Here's the story, in the last 3 months, our household income has DRAMATICALLY increased. As in, close to doubled. Now, it was pitiful before because my husband was barely making slave wages, but still, I feel kind of rich lately after the last couple of years. Now, before he got his new job and I got my raise, we were WELL below the median income, and even now, if you just go by the previous 6 months income, we are below the median income, but if they trustee projects out the NEXT 6 months, we will be above the median income by probably about $5-10K/year.
We have $40K worth of CC debt, $30K in student loans, and a mortgage we can't afford and will be surrendering. We will never be able to get out from under everything if they push us into a CH 13. Right now, part of the reason I feel rich is because I stopped paying the mortgage since we are surrendering, and that money is adding up nicely, but we will eventually have a rent payment again and when we do, it will eat up a considerable amount of our monthly take home pay... but the truth is, that as long as the Ch 7 is granted we are in a really really great position to make some great progress with our financial future. We aren'e exactly rolling in the dough, still living on a budget, not buying luxuries, etc, but we will for the first time in years have a little to put toward savings every month.
I'm just so nervous that we will get pushed into a 13 and snatch that possibility away.
We more than pass the means test I think given the allowable amounts, but I'm just nervous they will see that jump in income and say that we can afford a 13.
Anyone deal with anything similar? There isn't anything I can DO about it. We couldn't file sooner because it has taken us forever to save up the total amount of the filing/attorney's fee...
