    Stay Lifted?

    I have a secured creditor a credit union, lien is on a car. I have not paid them since October. They have not filed a motion to lift the auto stay. They did send me a letter asking that I turn the car over volentarly, I did not.

    As of today they still have not filed a motion to list stay.

    Question is, If the CU does not file a motion to lift the stay when is it lifted? At discharge or at closing?

    Any ideas as to why they would not file a motion to lift the stay?

    Someone can correct me if I'm wrong, but as soon as you are discharged they no longer need to lift the stay. So they are probably looking at waiting until after the discharge to take the car versus incurring legal fees to lift the stay.
