Our Chapter 7 was filed and discharged over with thank god. Now I pull my credit report and my private student loans through Citibank show a $0 balance and the status says included in bankruptcy. My other student loans show up to date and paying. So what is the deal with this. I called Citibank they are saying there is no way these loans were inlcuded, which i thought they were not either but why would the credit report show that if they were not. Someone please help these loans are costing me $200 a month.

Not sure what specifically happened, but you would know if they were discharged, they aren't automatically included. Citibank may have sold your loan or in the process of selling it, which the larger banks tend to do a lot when there is any kind of change in status. The customer service people may not have any idea about what is going on with that until it is actually complete. Are they still sending you a statement?

Was Citibank a creditor in your Chapter 7? If so, I have found that what can happen on your credit reports is that any past accounts you have had with that creditor can get changed as to that debt being discharged in bankrtupcy, even though the account may have already been paid in full before the filing. I am assuming that is what may have occurred with your student loans. You will have to dispute that information and may have to send in a copy of your creditor matrix to the CRAs involved to prove they were not included. We went through a similar mess with GEMB as they changed any account we had associated with them, even open after discharge, to being included in our Chapter 13. Took us a while but it is cleaned up. Best of luck._________________________________________

I just spoke with AIG the guarantor who bought 8 of the loans from citibank. I have no idea who they are because the representative told me that they do not report to the credit bureau and basically they cannot do anything to me and if I want to send them a letter telling them that the loans are included in the bankruptcy he would place the loans in bankruptcy status. This is all so confusing... Now what about citibank the credit report shows they are included so what do I do about them. Someone please help me
