Motion for Relief from Automatic Stay automobile

I emailed a question to my attorney but she sometimes takes a couple days to get back so I am throwing it out here to some of you experts. I filed on December 6th. Had my 341 on Jan. 14th. I was going to do the 722 redemption on my car but the finance company wouldn't agree on the amount the redemption company offered for the car. While all of this was going on, a motion to redeem and a motion for relief from automatic stay scheduled for later this week (on the same day). Since I am surrendering the car now, can these hearings be canceled and I contact the finance company to come pick up the car? And, if not, how soon will they come after the car after the automatic stay is lifted? I have another car so when doesn't matter when they pick it up but I hope they can at least pick it up during the day, thats all.

You don't need to cancel those hearings, you simply need not show up and the court will grant the Motion to Lift Stay (which basically allows the finance company to repo the car).

As for when they will actually come and get the car, that is anyones guess.

Exactly....the car is part of the bk, so the hearing cannot be canceled. You'll get documents within 2 weeks about the hearing.
