    341 scheduled

    Checked PACER and my 341 is scheduled for March 17. The last day for objection is May 17, 2008.

    Now lets hope the rest goes ok , there's no objections, and the trusty doesn't tell me I have to convert to a 13. Lets keep our fingers crossed.

    So now what happens?

      Thank you so much. NOW I understand how others get nervous when thinking about the 341.......I can feel the nervousness starting.

        Are you filing pro se or do you have an attorney?
        If you have an attorney what does he say your chances are of the trustee forcing you into a 13? Are you over the median income or have a lot of assets or ?
        I hope it works out for you! I hate to see people get forced into a 13. But of course you can (sometimes) convert that to a 7 later if you play your cards right.

          I hope it works out for you! I hate to see people get forced into a 13. But of course you can (sometimes) convert that to a 7 later if you play your cards right.

          I have an attorney and he says that there is a "slight" chance it will have to be converted. It's because I have furniture that I owe on and am reaffirming it and it'll be paid off in 6 months. But if I don't reaffirm the furniture and lose the payment, then I don't qualify for a 7. I'm just barely under after all allowable deductions because of the furniture payment. I am above the median income for Florida and have no assets. My atty then told me "well I probably shouldn't tell you this, but, because I'm not one of the good ole boys here I'm not that well liked by most of the trusty's, but then I've never lost an argument either." After he told me this I felt like I should have gone to another atty, but I had already paid him in full and was signing the papers. I sure hope all goes well. Keep the fingers crossed.

            Now I understand why you aren't giving up the furniture.

            I hope you get the Ch. 7, it'll all be over for you quicker that way! Good luck!!!

              Good luck on the waiting game. Regardless what chapter you go after, you are much better now than before!
