Hi everyone,

I'm filing next week and I'm sure the trustee will take my 2007 tax rebate. Not going to stress over it anymore. However, will they take my 2008, 2009?

No.
As to 2007, ask your attorney if the Trustee takes them or if you have exemptions you can exempt them with.
As to the rebate, I don't see how the Trustee can take it since you didn't "know" about it at the time of the 341, or time of filing, but some say he can.
Personally I think if Trustees take the rebate people should try to file suit against them.

If you're filing exempt, our lawyer told us that they can't take it. Not sure about any other way though....are you using a lawyer? He/she should know.

Interesting Trustee's are taking rebates when the sole purpose is to stimulate the economy. What will the Trustee's be stimulating when they take the $$$. I am not sure how many people are filing bankruptcy per day but at $600/person I bet this could add up & quick...

Money sort of follows the First Law of Thermodynamics..Money is neither created or destroyed..it simply changes hands. The money that the Trustee gets will be transferred to an entity that will most likely put it back in circulation by paying for goods or services..just like you or I or anyone would..and yes, it will stimulate the economy..
