    Filed chapter 7 last week

    I filed chapter 7 last week. My wagers are garnished, and I have a couple judgements against me and several creditors attemting to take me to court. Enough was enough and I had no choice but to file.

    I recieved a "stipulation of dismissal without prejudice" form from a creditor. Not trusting the creditor I looked up what it meant on the internet and found that they could refile a claim against me later on if I sign it.

    My question is, do I hae to sign it or is any action they were taking prior to filing null and void?
    I don't have an attorney and couldn't find a definate answer on the internet so I'm hoping someone here can answer.

    I Personally wouldn't sign anything from a creditor without legal advice from a lawyer..and then I still wouldnt sign it. I would say if they are included in the BK to just trash it. I am pro se and I have never heard of such form, sounds like trouble but maybe someone else can chime in.. Good Luck

      a Stipulation of Dismissal, without prejudice. Used by a plaintiff to dismiss a complaint previously filed. Plaintiff may desire to re-file complaint alleging other matters, or may dismiss in compliance with a settlement agreement.

        Have they halted the wage garnishment?
        I'd not sign anything. By law, they must halt all legal and collection action anyway.

          Don't sign it. The debt will be included in to the BK. The creditors will do anything and everything. Their offers are always one sided and they think we dumb and will go along with anything. Again, don't sign.
