When does discharge normally happen ?

When does discharge normally happen ? Is it 60 days from 341 meeting ? And how do i know ? Will my attorney notified me ? Will bankruptcy court notified me ? And under what category on Pacer will it appear in ? Also what will hold up a discharge and make it go beyond 60 days from 341 ?

Discharge typically happens within days to weeks once 60 days passes after your 341 meeting as long as no objections are filed by your creditors or your trustee (and obejctions are very rare).

If your Ch 7 case has assets involved that you can't protect with your state's exemptions that will extend your case - sometimes for quite a long time. Is your Ch 7 an asset case or a no-asset case?

If you get a free log-on and password to follow your case on PACER (Public Access to Court Electronic Records), you will see the discharge and then the closing filed there. You will also receive a copy of your discharge papers in the mail as well.

I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

    06/01/06 - Filed Ch 13
    06/28/06 - 341 Meeting
    07/18/06 - Confirmation Hearing - not confirmed, 3 objections
10/05/06 - Hearing to resolve 2 trustee objections
01/24/07 - Judge dismisses mortgage company objection
    09/27/07 - Confirmed at last!
06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
Countdown: 60 months paid, 0 months to go
