    Dismissed Without Prejudice

    I saw in an Arbitration thread that a lot of arb cases are "dismissed without prejudice". How often does this occur? Do you have to put up a fight for this dismissal? This person said the case ran from Feb to Oct, and then the case was dismissed. It appeared he didn't put up a fight (e.g. didn't respond to the arb notice, just letting it run its course).

      Generally, if the other party (defendant) does not show, the case is usually decided in favor of the plaintiff and not dismissed.

      I suppose if the plaintiff did not provide ANY supporting documents, the arbitrator would probably dismiss without prejudice.
